Earlier today, As I Lay Dying frontman Tim Lambesis appeared in court for the first time since he made bail late last month. While today could have been the day that a plea bargain would have been set, it appears that didn’t happen, as he’s due back in court on September 16th, the San Diego Reader reports. His preliminary hearing will  take place on that date. Lambesis appeared in a long-sleeved shirt to cover up his tattoos, and looked decidedly less menacing than his last appearance.

As you’ll probably remember, Lambesis was arrested on May 7 for allegedly soliciting a hitman to kill his wife, Meggan Lambesis. According to the prosecuting attorney, Lambesis met with a man named “Red,” actually an undercover officer, and gave him an envelope containing $1,000 cash, Meggan’s address and gate codes, and instructions on how to get into the place. The maximum sentence Lambesis can get for solicitation to commit murder is nine years, according to the prosecutor.

Lambesis is moving forward with plans for the third Austrian Death Machine album, which was successfully (over) crowdfunded.
