According to Variety, a judge has dismissed the lawsuit filed against the surviving members of Nirvana over the cover of their 1991 record, Nevermind.
The case was recently amended in November 2021 when Spencer Elden, the man known as the Nevermind baby on the iconic cover, amended the suit to drop former Nirvana drummer Chad Channing, as well as Warner Music, Heather Parry and Guy Oseary, from the defendants list.Filed in August, Elden claimed the photo constitutes child pornography and child exploitation as he seeked damages of either $150,000 from each of the 17 defendants or unspeficied damages to be determined at trial, attorney fees, an injunction to prohibit all parties “from continuing to engage in the unlawful acts and practices described herein,” and a trial by jury.
